 Homophobic Slur-Wielding North Dakota Rep Arrested For DUI Won’t Step Down

On December 15th, police arrested Nico Rios for driving under the influence. What makes his case somewhat unique is that he’s a representative for the state of North Dakota. On top of that, he hurled homophobic slurs at one of the officers at the scene. Now, in a public apology, it appears that he’s hopeful that he can continue to represent the state.

During the arrest, police reported finding an open container of alcohol in the vehicle. Rios wouldn’t agree to a breathalyzer test and officers arrested him at that stage. Amid the process, Rios told officers that they would regret their actions because they didn’t know who he was. He also used homophobic language and questioned one officer (who has an English accent) repeatedly about where he was from.

A police report said that Rios was “verbally abusive, homophobic, racially abusive and discriminatory… for the entire duration of the incident following roadside testing.” Bodycam video backs that up. In response, Rios released a statement apologizing for his conduct but appeared to focus solely on driving under the influence. In addition, he made no commitment to step down from his position.

“I apologize to those I have hurt and disappointed with my shameful actions… I completely understand why some people want me to step aside. These calls have not gone unheard. I am seriously mulling all aspects of my future.” The post read in part. Considering different avenues for one’s future is all well and good but many appear unsatisfied with the idea of having a representative who would do what Rios has done.

“There is no room in the legislature, or our party, for this behavior. I understand people make mistakes, but his comments and defiance to law enforcement are beyond the pale. In addition, any lawmaker attempting to use his or her elected position to threaten anyone or skirt the law is completely unacceptable,” Lefor said in a statement to the Associated Press.

Direct responses to Rios’ post reflect similar sentiments on X. One went as far as to point out that for some, it’s not the DUI that is the main problem, but the thinking that led to the comments that Rios made during the stop.
